Aquestive Therapeutics Provides Update Regarding Suboxone® Sublingual Film Litigation

WARREN, N.J., Feb. 5, 2019 /PRNewswire/ -- Aquestive Therapeutics, Inc. (Nasdaq: AQST), a specialty pharmaceutical company, focused on developing and commercializing differentiated products to solve therapeutic problems, today announced that the U.S. Court of Appeals for the Federal Circuit denied a motion for a rehearing to reinstate the preliminary injunction against Dr. Reddy's Laboratory (DRL) regarding Suboxone® (buprenorphine/naloxone) Sublingual Film. This decision is not a judgement in the ongoing infringement cases against DRL and others regarding potential generic products entering the U.S. market. Any company, including DRL, introducing a generic alternative to Suboxone prior to the final court decision is doing so "at risk" with respect to the final outcome.

"This is one more step on the path to a final decision regarding the intellectual property infringement claims against DRL and others for potential generic Suboxone products. We will continue to work with Indivior to vigorously pursue all legal options in order to protect the Suboxone-related patent portfolio. Today's action does not change the validity and assertability of any of the existing and future patents in our portfolio," said Keith Kendall, CEO of Aquestive Therapeutics. "Aquestive is the sole and exclusive worldwide manufacturer of the brand and authorized generic products. Independent of the final decision, even if generics enter the market at risk, Aquestive will continue to manufacture and deliver a significant volume of Suboxone Sublingual Film, generating substantial revenue for our business in 2019."

"We also continue to be focused on and excited by the progress of our proprietary product portfolio. Our recent launch of Sympazan (clobazam) Oral Film has been received well by the market. As planned, we have started the filing process with the FDA for Exservan (riluzole) Oral Film and our Libervant (diazepam) Buccal Film program is moving forward following our meeting with the FDA in late December. These late stage products, along with earlier assets in our pipeline, provide several platforms for future growth."
